Welcome to InkForged Lab.

These Terms of Service govern your use of the InkForged Lab website and your purchase of products or services from us.

By accessing our website, placing an order, or purchasing products or services from InkForged Lab, you agree to these Terms of Service and our other posted policies, including our Returns & Refund Policy, Shipping Policy, and Privacy Policy.

If you do not agree with these Terms, please do not use our website or purchase our products or services.

2. Online Store Terms

You may not use our products, services, or website for any unlawful or unauthorized purpose.

You may not attempt to interfere with the security, operation, or functionality of our website.

We reserve the right to refuse service, cancel an order, or limit purchases when reasonably necessary, including in cases of suspected fraud, unauthorized activity, pricing errors, intellectual property concerns, or violations of these Terms.

3. Products and Product Information

We make reasonable efforts to display our products, designs, colors, descriptions, and photographs as accurately as possible.

However, colors and product appearance may vary slightly due to:

• Screen or device settings
• Lighting
• Garment material
• Printing or transfer processes
• Manufacturing variations
• differences between digital artwork and the finished product

Minor variations in print placement, color, texture, or appearance that are normal to the production process are not considered defects.

Product availability may change without notice.

We reserve the right to modify or discontinue products or designs at any time.

4. Pricing

All prices are displayed in U.S. dollars unless otherwise stated.

Prices may change without notice.

The price charged for an order will generally be the price displayed at the time of order is submitted, subject to correction of obvious pricing, typographical, or technical errors.

Applicable taxes, shipping charges, and other charges will be displayed during checkout when required.

5. Orders

Submitting an order does not guarantee that the order will be accepted.

We reserve the right to refuse, limit, or cancel an order for reasons including, but not limited to:

• Product or size availability
• Pricing or description errors
• Payment authorization issues
• Suspected fraud
• Customer-provided content that may violate intellectual property rights
• Content that we determine cannot reasonably or lawfully be produced
• Technical or inventory errors

If payment has already been collected for an order that we cancel, the applicable amount will be refunded to the original payment method.

Customers are responsible for providing accurate billing, shipping, contact, sizing, and personalization information when placing an order.

6. Custom and Personalized Orders

InkForged Lab may offer custom or personalized apparel and other products.

Customers are responsible for carefully reviewing all information submitted for a custom order, including:

• Names
• Dates
• Spelling
• Sizes
• Colors
• Images
• Logos
• Artwork
• Wording
• Placement requests
• Other personalization details

If a proof or design preview is provided for approval, customer approval authorizes InkForged Lab to proceed with production based on the approved version.

Once production has started, custom or personalized orders generally cannot be changed or canceled.

Custom and personalized merchandise is subject to the terms of our Return & Refund Policy and is generally considered final sale unless the product arrives damaged, defective, or materially different from the approved or ordered design.

7. Customer-Provided Artwork, Logos, and Images

When you provide InkForged Lab with photographs, logos, graphics, artwork, trademarks, text, or other materials for use in a custom product, you represent that you own the material or have the necessary permission or legal right to use and reproduce it.

You are responsible for obtaining any required licenses, permissions, or authorizations relating to customer-provided content.

By submitting customer-provided content to us for an order, you grant InkForged Lab a limited, non-exclusive permission to use, reproduce, resize, adjust, format, print, or otherwise process that content solely as reasonably necessary to create and fulfill your requested product or service.

Ownership of customer-provided original content remains with the customer or its lawful owner.

InkForged Lab may refuse or cancel a custom order if we reasonably believe the submitted content infringes another person's intellectual property rights or otherwise violates applicable law.

8. InkForged Lab Designs and Intellectual Property

Unless otherwise indicated, original InkForged Lab artwork, graphics, logos, branding, product designs, photographs, text, website content, and other creative materials are owned by or licensed to InkForged Lab.

Purchasing a physical product does not transfer ownership of the underlying artwork, designs, trademark, copyright, or other intellectual property.

InkForged Lab designs may not be copied, reproduced, resold as digital artwork, commercially distributed, or used to create competing merchandise without our written permission.

9. Payment

Payment must be successfully authorized before an order can be processed.

Available payment methods are displayed during checkout.

You agree to provide current, complete, and accurate billing and payment information.

We are not responsible for delays caused by declined payments, incorrect billing information, payment processor issues, or fraud-prevention reviews outside of our reasonable control.

10. Shipping and Delivery

Shipping rates estimated processing times, available shipping methods, and other shipping terms are governed by our shipping policy.

Delivery rates provided by carriers are estimates unless expressly stated otherwise.

Once an order has been transferred to a shipping carrier, delays may occur due to weather, carrier disruptions, holidays, incorrect addresses, or other circumstances outside our reasonable control.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

11. Returns, Exchanges, and Refunds

Returns, exchanges, cancellations, damaged items, incorrect items, and refunds are governed by our posted Return & Refund Policy.

Customers should review that policy before completing a purchase.

12. Incorrect Shipping Information

Customers are responsible for providing a complete and accurate shipping address.

If an order is returned because of an incorrect. incomplete, or undeliverable address supplied by the customer, additional shipping charges may apply before the order is reshipped.

If you notice an address error after placing the order, contact us as soon as possible. We cannot guarantee that an address can be changed after an order has entered fulfillment or has been transferred to the shipping carrier.

13. Prohibited Uses

You may not use our website, products, services, or content:

• To infringe copyrights, trademarks, or other intellectual property rights

We do not guarantee that the website will always be uninterrupted, completely error-free, or available at all times.

Nothing in these Terms limits any warranty, consumer protection, or other legal right that cannot be waived under applicable law.

16. Limitation of Liability

To the fullest extent permitted by applicable law, InkForged Lab will not be liable for indirect, incidental, special, or consequential damages resulting solely from the use or inability to use our website, products, or services.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expense arising from customer-provided materials that infringe or violate the intellectual property or other legal rights of a third party, provided the claim results from materials you supplied to InkForged Lab for reproduction use.

This Provision does not apply to infringement caused independently by InkForged Lab.

18. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.

19. No Waiver

Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce hat provision in the future.

20. Governing Law

These Terms and any transactions with InkForged Lab are governed by applicable federal law and the laws of the State of New York, without limiting any consumer rights that cannot legally be waived.

21. Changes To These Terms

We may update these Terms of Service from time to time to reflect changes to our business, website, products, services, or applicable requirements.

The current version will be posted on this website with an updated revision date.

Changes apply prospectively unless otherwise required by law.
